Legal Framework, Financial Undertakings, and Temporary Resident Alternatives
The Parents and Grandparents Program (PGP) allows Canadian citizens and permanent residents to sponsor their biological or adoptive parents and grandparents for Canadian Permanent Residence (PR) under the Family Class of the Immigration and Refugee Protection Act (IRPA) and Regulations (IRPR).
Program Intake Dynamics & Current Operational Status
Unlike spousal or dependent child sponsorships, which operate on an open, rolling basis, the PGP functions under strict annual intake limits controlled by Ministerial Instructions:
PGP INTAKE SYSTEM OVERVIEW
- Interest to Sponsor Pool: Sponsors submit an initial digital entry.
- Random Selection / Lotteries: IRCC issues Invitations to Apply (ITAs) drawn exclusively from the pool of registered interest forms.
- Strict Caps: Annual complete application processing limits are set under the Canada Immigration Levels Plan.
Operational Update:
New intake of Interest to Sponsor forms for the PGP is paused. IRCC processes inventory from previous invitation rounds to manage application volumes and processing times responsibly.
Strict Income Requirements: The 3-Year LICO + 30% Rule
Sponsors in the PGP must meet higher financial benchmarks compared to other family reunification streams. Under IRPR Section 133(1)(j), sponsors must prove they have met the Minimum Necessary Income (MNI) for 3 consecutive taxation years preceding the date of application submission.
The 3-Year MNI Calculation Rule
Sponsor Income Threshold = LICO + 30% Extra
- Proven strictly via Canada Revenue Agency (CRA) Notices of Assessment.
- Family size calculation includes: Sponsor + Sponsor’s Dependents + Sponsored Persons + Their Dependents.
- Co-signing: ONLY a spouse or common-law partner can co-sign to combine income; siblings, adult children, or other relatives cannot co-sign.
The 20-Year Financial Undertaking
| Sponsorship Category | Undertaking Duration | Legal Responsibility |
|---|---|---|
| Parents & Grandparents (Federal) | 20 Years (from the date PR status is granted). | Full financial responsibility for basic needs (food, shelter, healthcare). Must repay any provincial social assistance claimed by the sponsored relative during this 20-year window. |
| Parents & Grandparents (Quebec) | 10 Years. | Governing framework set under Quebec immigration regulations. |
