In Ontario, landlords and tenants have the legal right to end a tenancy early by mutual consent using an Agreement to End the Tenancy (Form N11). When executed correctly, a Form N11 provides a clean, cooperative, and legally binding conclusion to a lease under the Residential Tenancies Act, 2006 (RTA).

At Lex Defensio, we assist landlords in negotiating, drafting, and enforcing Form N11 agreements to ensure full statutory compliance, protect property rights, and avoid costly Landlord and Tenant Board (LTB) delays.

Technical & Legal Requirements for Form N11

While Form N11 is a voluntary agreement, strict legal rules govern its validity. Failure to adhere to these rules can render the agreement void at the LTB.

1. Genuine Mutual Consent

  • Voluntary Execution: Both the landlord and tenant must freely agree to terminate the tenancy. An N11 cannot be coerced, forced, or served as an eviction notice.
  • Timing Restrictions at Lease Signing: Under Section 37(7) of the RTA, a Form N11 is legally void if signed at the exact same time the initial tenancy agreement is created. Landlords cannot require a tenant to pre-sign an N11 as a condition of renting the unit.

2. Immediate L3 Filing Option

Unlike fault-based notices (such as N4, N5, or N7), an N11 allows a landlord to apply for an eviction order ex parte (without a full formal hearing):

  • If the tenant signs an N11 but later refuses to move out, the landlord can immediately file an L3 Application (Application to End a Tenancy and Evict a Tenant – Tenant Gave Notice or Agreed to End the Tenancy) with the LTB.
  • Strict Filing Deadline: The L3 Application must be submitted to the LTB no later than 30 days after the agreed-upon termination date specified on the Form N11.

Form N11 Process Workflow

  1. Mutual Agreement Reached
  2. Sign Official Form N11
  3. Prepare for Move-Out Date
    • Tenant Vacates Unit Smoothly — Final Move-Out Inspection
    • Tenant Refuses to Vacate — File L3 Ex Parte Application → LTB Eviction Order Granted → Sheriff Enforcement

Key Benefits of Form N11 for Landlords

  • Bypasses Hearing Backlogs: An L3 Application based on a signed N11 is processed faster via ex parte orders, avoiding the long wait times associated with standard LTB hearings.
  • No Compensation Required: Unlike an N12 (Landlord’s Own Use) or N13 (Renovations), a standard N11 mutual agreement does not legally require the landlord to pay statutory compensation to the tenant, unless specifically negotiated as part of a voluntary Cash-for-Keys agreement.
  • Clear Termination Date: Establishes an agreed-upon date for vacant possession, allowing landlords to re-rent, renovate, or list the property with confidence.
