In Ontario, a landlord may terminate a tenancy early under the Residential Tenancies Act, 2006 (RTA) if they, an immediate family member, or a purchaser require the rental unit for personal residential occupation.

Given strict Landlord and Tenant Board (LTB) scrutiny surrounding “good faith” requirements and technical procedure, precision is paramount. At Lex Defensio, we assist landlords in navigating Form N12 requirements, preparing bulletproof evidentiary packages, fulfilling statutory compensation duties, and securing eviction orders.

Technical Statutory Requirements for Form N12

Form N12 carries strict statutory obligations under Sections 48 and 49 of the RTA. Failure to adhere to any single requirement will result in the immediate dismissal of the application at the LTB.

1. Permitted Individuals (Who May Occupy)

An N12 Notice can strictly only be issued if the unit is required as a principal residence by:

  • The landlord or their spouse.
  • A child or parent of the landlord or their spouse.
  • A caregiver providing care services to the landlord or any of the above family members.
  • A purchaser (under a signed Agreement of Purchase and Sale) or the purchaser’s spouse, child, parent, or caregiver.

Corporate Landlord Warning: If the landlord is a corporation, Form N12 cannot be issued for personal use, unless the corporation is owned by a single individual or a married couple and specific statutory criteria are met.

2. Notice Periods & Termination Date

  • 60 Days’ Minimum Notice: Landlords must provide at least 60 days’ written notice.
  • End of Term Requirement: The termination date specified on Form N12 must align with the end of a fixed-term lease, or the last day of a rental period (e.g., the last day of the month for month-to-month tenancies).

3. Mandatory Statutory Compensation (Section 48.1)

The landlord must provide the tenant with financial compensation equal to one month’s rent, or offer them another rental unit acceptable to the tenant.

  • Strict Payment Deadline: Compensation must be paid on or before the termination date listed on the Form N12. Failure to pay compensation by this exact date renders the notice invalid at the LTB.

4. Mandatory One-Year Personal Occupancy Rule

The person moving in must genuinely intend to occupy the rental unit as their principal residence for at least one full year (12 consecutive months).

  • Bad Faith Penalties: If the landlord re-rents, sells, or advertises the unit within 12 months of eviction without a legitimate unforeseen change in circumstances, the LTB presumes bad faith. Penalties can include damages up to $35,000+ paid to the tenant, a year’s rent differential, and fines up to $50,000 to $250,000.

Legal & Procedural Workflow

  1. Qualifying Personal Use Requirement Identified
  2. Serve Form N12 with Minimum 60 Days’ Notice
  3. File L2 Application with the LTB
  4. Pay Mandatory 1 Month’s Compensation ON or BEFORE Termination Date
    • Tenant Vacates Voluntarily — Final Unit Inspection
    • Tenant Disputes Notice — LTB Hearing (L2 Application) → Affidavit / Oral Testimony → LTB Eviction Order Issued → Sheriff Enforcement

The L2 Hearing & Proving “Good Faith”

If a tenant refuses to vacate or disputes the notice, the landlord must advance the case to the LTB:

  1. Filing the L2 Application: The landlord files a Form L2 (Application to End a Tenancy and Evict a Tenant) with the LTB after serving the N12.
  2. Mandatory Declaration/Affidavit: Under RTA Section 55.1, the landlord or the person moving in must submit a signed sworn affidavit confirming their genuine intention to occupy the unit for at least one year.
  3. Good Faith Scrutiny: At the hearing, the LTB Adjudicator will evaluate evidence (e.g., current living arrangements, employment locations, sale agreements) to ensure the notice is not being used as a pretext for eviction.
